Law by Decree No. 2 of 2016 on Customs Police

The President of the State of Palestine

Chairman of the Executive Committee of the Palestine Liberation Organisation

In accordance with the provisions of the Amended Basic Law of 2003 and its Amendments, particularly Article 43 thereof,

And the provisions of the Law of Service in the Palestinian Security Forces No. 8 of 2005,

And the provisions of the Customs and Excise Law No. 1 of 1962,

And upon the recommendation of the Council of Ministers on 29/12/2015,

Based upon the powers bestowed upon me, and

In accomplishment of the public interest,

In the name of the Arab Palestinian people,

I hereby promulgate the following Law by Decree:

Article 1

The following words and expressions used in this Law by Decree shall have the meanings specified below, unless the context determines otherwise:

The Customs Police Agency: A force within the Palestinian Internal Security Forces to which the laws and regulations of the Palestinian Security Forces shall apply. It performs its functions and exercises its powers under the applicable laws, headed by the DirectorGeneral who issues decisions to manage its work.

The Director-General: The Director-General of the Customs Police.

Article 2

The administrative reference of the customs police shall be the Ministry of Interior and its technical and practical reference is the Ministry of Finance and Planning.

Article 3

The Director-General of the Customs Police shall be appointed by a decision of the President of the State of Palestine upon the recommendation of the Council of Ministers.

Article 4

In order to facilitate their mission in accordance with the law, the members of the customs police of officers and non-commissioned officers shall have the capacity of judicial police with respect to their work.

Article 5

The Palestinian security laws and regulations shall apply to officers, non-commissioned officers and customs police personnel. And the Civil Service Law shall apply to civil servants employed by the Customs agency.

Article 6

The Council of Ministers shall issue the necessary regulations to implement the provisions of this Law by Decree.

Article 7

All provisions that contradict the provisions of this Law by Decree shall be repealed.

Article 8

This Law by Decree shall be presented to the Legislative Council in the first session it convenes for approval.

Article 9

All the competent authorities, each one within its sphere of jurisdiction, shall implement the provisions of this Law by Decree, which shall enter into force as of the date of its publication in the Official Gazette.
