Decision No. 118 of 2012 Concerning the Prosecution and Detention of Senior Military Ranks from Major through Colonel

The President of the State of Palestine

The Chairman of the Executive Committee of the Palestine Liberation Organisation

The President of the Palestinian National Authority

The Commander-in-Chief of the Palestinian Forces

In reference of the provisions of the Amended Basic Law of 2003 and its Amendments,

Having reviewed the Revolutionary Penal Law of the Palestinian Liberation Organisation of 1979,

Having reviewed the Revolutionary Procedural Law of the Palestinian Liberation Organisation of 1979, particularly Article 89(a) thereunder,

Based upon the powers bestowed upon me, and

In accomplishment of the public interest,

I hereby promulgate the following Decision:

Article 1

The Chairman of the Military Justice Authority, President of the High Court, shall be authorised with granting permission to detain senior military ranks from major through colonel on behalf of the Commander-in-Chief of the Palestinian Security Forces.

Article 2

All the competent authorities, each one within its sphere of jurisdiction, shall implement the provisions of this Decision, which shall enter into force as of the date of its promulgation and shall be published in the Official Gazette.

Issued in the city of Ramallah on November 25th, 2012 Anno Domini.

Corresponding to Muharram 11th, 1434 Anno Hegira.
