Concerning the Suspension of the Enforcement of the Limitation Periods, Legal Deadlines and Statutory Time Limits Relating to the Challenge before Settlement Courts during the Periods of Lockdown under the State of Emergency

In reference of the Bylaw of the Palestine Liberation Organisation,

The Amended Basic Law of 2003, as amended,

Having reviewed the Law on Land and Water Settlement No. 40 of 1952, as amended,

The Law by Decree No. 10 of 2020 Concerning the Suspension of the Limitation Periods, Legal Deadlines and Statutory Time Limits during the State of Emergency,

The Law by Decree No. 20 of 2020 Concerning the Suspension of the Enforcement of Laws by Decrees Relating to the State of Emergency,

The Presidential Decree No. 4 of 2020 Concerning the Declaration of the State of Emergency,

The Presidential Decree No. 5 of 2020 Concerning the Extension of the State of Emergency,

The Law by Decree No. 23 of 2020 Concerning the Approval of the Extension of the State of Emergency,

The Presidential Decree No. 6 of 2020 Concerning the Declaration of the State of Emergency,

The Presidential Decree No. 8 of 2020 Concerning the Extension of the State of Emergency,

The Law by Decree No. 25 of 2020 Concerning the Approval of the Extension of the State of Emergency,

The Presidential Decree No. 9 of 2020 Concerning the Declaration of the State of Emergency,

Based upon the recommendation of the Council of Ministers, dated August 10th, 2020,

Based upon the powers vested in me, and

In pursuance of the public interest,

I hereby promulgate the following Law by Decree:

Article 1

Notwithstanding the provisions of any other piece of legislation, the enforcement of the limitation periods, legal deadlines, and statutory time limits relating to the challenge before settlement courts shall be suspended during the periods of total or partial lockdown under the state of emergency.

Article 2

The enforcement of the limitation periods, legal deadlines, and statutory time limits, provided for under Article 1 of this Law by Decree, shall be resumed as of the day following the end of the state of emergency, or the day following the announcement by the competent authority of the resumption of regular work, or the expiration of the period of total or partial lockdown.

Article 3

Any period of total or partial lockdown, which was previously announced by the competent authority within the framework of the state of emergency measures to control the coronavirus (COVID-19) pandemic, shall be deemed to be included within the provisions of this Law by Decree.

Article 4

All provisions that contradict the provisions of this Law by Decree shall be repealed.

Article 5

All the competent authorities, each one within its sphere of jurisdiction, shall implement the provisions of this Law by Decree and shall enter into force as of date of its promulgation and shall be published in the Official Gazette.
