Concerning the Judicial Recess of the Justice Commission of the Security Forces for the Year 2020

The Chairman of the Executive Committee of the Palestine Liberation Organisation

In reference of the Bylaw of the Palestine Liberation Organisation,

The Amended Basic Law of 2003, as amended,

Having reviewed the Law by Decree No. 2 of 2018 on the Justice Commission of the Security Forces, particularly Article 57 thereunder,

The Presidential Decree No. 1 of 2020 Concerning the Declaration of the State of Emergency,

The Presidential Decree No. 3 of 2020 Concerning the Extension of the State of Emergency,

The Law by Decree No. 9 of 2020 Concerning the Approval of the Extension of the State of Emergency,

The Presidential Decree No. 4 of 2020 Concerning the Declaration of the State of Emergency,

The Law by Decree No. 10 of 2020 Concerning the Suspension of the Limitation Periods, Legal Deadlines and Statutory Time Limits during the State of Emergency,

The Law by Decree No. 11 of 2020 Concerning the Deferment of Confinement in Judgement Enforcement Actions during the State of Emergency,

The Law by Decree No. 16 of 2020 Concerning the Continued Enforcement of the Laws by Decrees, Decisions and Measures Relating to the State of Emergency,

The Law by Decree No. 20 of 2020 Concerning the Suspension of the Enforcement of Laws by Decrees Relating to the State of Emergency,

Based on the letter of the Chairman of the Justice Commission of the Security Forces, dated May 27th, 2020,

Based upon the powers vested in me, and 

In pursuance of the public interest,

 

I hereby promulgate the following Law by Decree:

Article 1

Notwithstanding the provisions of any other piece of legislation:

1. The period from March 10th, 2020 to May 10th, 2020 shall be deemed to be the judicial recess of the Justice Commission of the Security Forces for the year 2020.

2. The military courts shall continue to work during the period from July 15th, 2020 to August 31st, 2020 in accordance with the procedures and instructions set forth by the Chairman of the Justice Commission of the Security Forces.

Article 2

1. In case the lawyer wishes to use their leave during the legally prescribed judicial recess, they shall submit a written application, notifying the Chairman of the Justice Commission of the Security Forces thereof at least one week prior to its commencement.

2. The military courts shall abide by postponing the cases of the lawyers who wish to use their leaves in accordance with Paragraph 1 of this Article to an appropriate date after their completion.

Article 3

All provisions that contradict the provisions of this Law by Decree shall be repealed.

Article 4

All the competent authorities, each one within its sphere of jurisdiction, shall implement the provisions of this Law by Decree and shall enter into force as of the date of its promulgation towards the end of 2020 and shall be published in the Official Gazette.
