On the Amendment of the Regulation of Public Procurement No. 5 of 2014, as Amended

The Council of Ministers,

In reference of the provisions of the Amended Basic Law of 2003, as amended, particularly the provisions of Article 70 thereunder,

The provisions of the Public Procurement Law No. 8 of 2014, as amended,

The provisions of the Decision of the Council of Ministers No. 5 of 2014 on the Regulation of Public Procurement, as amended,

Based upon the recommendation of the Higher Council for Public Procurement Policies,

The approval of the Council of Ministers, dated May 4, 2020,

The powers bestowed upon it,

In pursuance of the public interest,

Hereby promulgates the following Regulation:

Article 1

For the purposes of the present amendment, the Regulation of Public Procurement No. 5 of 2014, as amended, shall be referred to as the Original Regulation.

Article 2

Article 13 of the Original Regulation shall be amended so as to become as follows:

The Council of Ministers shall establish, upon a recommendation from the Minister of Finance, a central committee for tenders for non-consulting supplies and services as well as consulting services, with the exception of the consulting services relating to works, comprising nine members as follows:

Director General of Supplies at the Ministry of Finance

as chairman

A representative of the Ministry of Finance

as member

A representative of the Ministry of National Economy

as member

A representative of the Ministry of Public Works and Housing

as member

A representative of the Ministry of Information Technology and Telecommunications

as member

A representative of the Secretariat General of the Council of Ministers

as member

A representative of the Palestine Standards Institution

as member

Two representatives of the procuring entity, to be nominated by the competent official

as two members

Article 3

Article 3

All provisions that contradict the provisions of this Regulation shall be repealed.

Article 4

All the competent authorities, each one within its sphere of jurisdiction, shall implement the provisions of this Regulation, which shall enter into force thirty days after it is published in the Official Gazette.

Promulgated in the city of Ramallah on May 4th, 2020 Anno Domini,

Corresponding to Ramadan 11th, 1441 Anno Hegira.
