Decree No. 11 of 2011 Concerning the Approval of the Arab Convention on the Transfer of Inmates of Penal and Reform Institutions

Having reviewed the Amended Basic Law of 2003 and its amendments,

Having reviewed the Decree promulgated on May 19^th, 2010 Concerning the Approval of the Arab Convention on the Transfer of Inmates of Penal and Reform Institutions,

Having reviewed the Decision issued forth by the Councils of Arab Ministers of Interior and Justice, convened in Cairo on December 21^st, 2010,

Based upon the recommendation of the Council of Ministers, dated January 11^th, 2011,

Based upon the powers bestowed upon me, and

In accomplishment of the public interest,

I hereby promulgate the following Decree:

Article 1

The amendment of the Arab Convention on the Transfer of Inmates of Penal and Reform Institutions, issued forth by the Councils of Arab Ministers of Interior and Justice, convened in Cairo on December 21^st, 2011, shall be approved. Replacing the text of paragraph (7) of the Concluding Provisions under the Convention, with the following text:

“The State Party may propose and refer any provision under this Convention to the Secretary General of the League of Arab States, who communicates it to the States Parties to the Convention for a decision on its adoption by a majority vote of two thirds of the States Parties. Such amendment shall enter into effect thirty days after the date of depositing the ratification documents, or admittance or approval by seven States Parties at the Secretariat General of the League of Arab States.”

Article 2

All the competent authorities, each one within its sphere of jurisdiction, shall implement the provisions of this Decree, which shall enter into force as of the date of its promulgation and shall be published in the Official Gazette.
