Law by Decree No. 6 of 2011 Concerning the Amendment of the Law on Charitable Associations and Civil Society Organisations No. 1 of 2000

Having reviewed the Amended Basic Law of 2003 and its Amendments, particularly Article 43 thereunder,

Having reviewed the Law on Charitable Associations and Civil Society Organisations No. 1 of 2000,

Based upon the powers bestowed upon me, and

In accomplishment of the public interest,

In the name of the Arab Palestinian people,

I hereby promulgate the following Law by Decree:

Article 1

For the purposes of this amendment, the Law on Charitable Associations and Civil Society Organisations No. 1 of 2000 shall be referred to under this Law by Decree as the Original Law.

Article 2

Article 39 of the Original Law shall be amended so as to become as follows:

In the event the association or organisation is dissolved, the Department shall appoint for it a paid liquidator to take stock of its properties and contents. When the liquidation is complete, the Ministry shall transfer its movable and immovable properties to the Public Treasury of the Palestinian National Authority or to a Palestinian association with similar goals, taking into account the pensions, remunerations and rights of the employees of the dissolved association or organisation. These shall be excluded from the process of transfer.

Article 3

The Ministry shall rectify the positions of registered associations and organisations before this Law by Decree enters into effect in consistence with its provisions. The associations and organisations shall be informed thereof.

Article 4

All provisions that contradict the provisions of this Law by Decree shall be repealed.

Article 5

This Law by Decree shall be presented to the Legislative Council in the first session it convenes for approval.

Article 6

All the competent authorities, each one within its sphere of jurisdiction, shall implement the provisions of this Law by Decree, which shall enter into force as of the date of its publication in the Official Gazette.
