Law by Decree No. 26 of 2019

Concerning the Amendment of the Law No. 8 of 1964 on Insurance and Salaries, as Amended

The President of the State of Palestine

The Chairman of the Executive Committee of the Palestine Liberation Organisation

In reference of the Bylaw of the Palestine Liberation Organisation,

The provisions of the Amended Basic Law of 2003, as amended,

Having reviewed the provisions of the Law No. 8 of 1964 on Insurance and Salaries, as amended,

The powers vested in me, and

In pursuance of the public interest,

I hereby promulgate the following Law by Decree:

Article 1

For the purposes of introducing this amendment, the Law No. 8 of 1964 on Insurance and Salaries, as amended, shall be referred to as the Original Law.

Article 2

A new article shall be added to the Original Law after Article 38, bearing number 38 bis providing as follows:

1. Any previous duration of service that is admissible for retirement in accordance with the Law on Civil Retirement No. 34 of 1959, as amended, or in accordance with any other retirement law, shall be admitted for retirement in line with the provisions of the Original Law, and shall include the duration of service admissible for retirement in accordance with its provisions.

2. The Public Treasury shall afford to pay the retirement benefits calculated in line with the formula of the Law on Civil Retirement No. 34 of 1959, as amended, or in line with any other retirement law, for the durations of service referred to under Paragraph 1 of this Article after they are combined with the duration of service in accordance with the Original Law.

Article 3

All provisions that contradict the provisions of this Law by Decree shall be repealed.

Article 4

All the competent authorities, each one within its sphere of jurisdiction, shall implement the provisions of this Law by Decree, without prejudice to the established legal statuses. It shall enter into force as of the date of its publication in the Official Gazette.
