Law by Decree No. 25 of 2019

Concerning the Amendment of the Law by Decree No. 8 of 2014 on Public Procurement

The President of the State of Palestine

The Chairman of the Executive Committee of the Palestine Liberation Organisation

In reference of the Bylaw of the Palestine Liberation Organisation,

The provisions of the Amended Basic Law of 2003, as amended,

Having reviewed the provisions of the Law by Decree No. 8 of 2014 Concerning Public Procurement, as amended,

Based upon the recommendation of the Council of Ministers, dated December 2^nd, 2019,

The powers vested in me, and

In pursuance of the public interest,

I hereby promulgate the following Law by Decree:

Article 1

For the purposes of introducing this amendment, the Law by Decree No. 8 of 2014 Concerning Public Procurement shall be referred to as the Original Law.

Article 2

Paragraph 1 of Article 7 of the Original Law shall be amended so as to become as follows:

1. In accordance with a decision from the Council of Ministers, the Council shall be comprised of a Chair and eight members, who represent the following bodies:

a. The Ministry of Finance as a Deputy Chair

b. The Ministry of Public Works and Housing as a member

c. The Ministry of National Economy as a member

d. The Ministry of Local Government as a member

2. Four members who are experienced and specialised in the field of public procurement, other than civil servants, to be identified by the Council of Ministers from among those working in the contracting sector, medicine supplies, information and communications technology, and academic sector.

Article 3

All provisions that contradict the provisions of this Law by Decree shall be repealed.

Article 4

All the competent authorities, each one within its sphere of jurisdiction, shall implement the provisions of this Law by Decree, which shall enter into force as of the date of its publication in the Official Gazette.
