Law by Decree No. 13 of 2014 Concerning the Amendment of the Anti-Corruption Law No. 1 of 2005

The President of the State of Palestine

The Chairman of the Executive Committee of the Palestine Liberation Organisation

In reference of the provisions of the Amended Basic Law of 2003 and its Amendments, particularly Article 43 thereunder,

Having reviewed the Law on the Judicial Authority No. 1 of 2002,

Having reviewed the Law on the Formation of Regular Courts No. 5 of 2001, as amended,

The Penal Procedure Law No. 3 of 2001,

The Anti-Corruption Law No. 1 of 2005, as amended,

Based upon the powers bestowed upon me, and

In accomplishment of the public interest,

In the name of the Arab Palestinian people,

I hereby promulgate the following Law by Decree:

Article 1

The provisions of Paragraph 1 of Article 16 of the Amended Anti-Corruption Law shall be amended so as to become as follows:

"Upon a decision from the High Judicial Council based upon a request by the Chairman of the Commission, a competent court shall be formed to hear the cases of corruption crimes wherever they occur. It shall convene under the presidency of a judge in the grade of a Court of First Instance or a Presiding Judge by a decision from the High Judicial Council, or one who is delegated to preside it from among judges of the Court of Appeals, with the membership of two judges, the grades of whom shall not be below a judge of a Court of First Instance".

Article 2

All provisions that contradict the provisions of this Law by Decree shall be repealed

Article 3

This Law by Decree shall be presented to the Legislative Council in the first session it convenes for approval.

Article 4

All the competent authorities, each one within its sphere of jurisdiction, shall implement the provisions of this Law by Decree, which shall enter into force as of the date of its publication in the Official Gazette.
