Decision No. 288 of 2007 Concerning the Establishment of Committees for the Adaptation of the Personnel of the Palestinian Security Forces to Qualification Requirements

The President of the Palestinian National Authority

Having reviewed the Amended Basic Law of 2003 and its Amendments,

The Law of Service in the Palestinian Security Forces No. 8 of 2005,

Based upon the recommendation of the Council of Ministers, dated August 6^th, 2007,

Based upon the powers bestowed upon me, and

In accomplishment of the public interest,

I hereby promulgate the following Decision:

Article 1

Committees of the Military Intelligence, Military Medical Services and the relevant security agency shall be established to adapt the personnel of the Palestinian security forces to qualification requirements and medical fitness. The committees shall perform the following tasks:

1. Ensure that the personnel of the Palestinian security forces are fit for the legal conditions and qualification and medical fitness requirements, which qualify them to work in the security agencies.

2. Enumerate the personnel of security forces who are present abroad and offer opinion on the termination of the service of unlawful ones.

3. Enumerate the personnel of security forces who are not actually on duty.

4. Enumerate the personnel of security forces who are seconded or delegated to agencies or institutions beyond their positions.

Article 2

The committee shall submit its report to the Prime Minister within a maximum period of thirty days from the date [of the promulgation of this Decision].

Article 3

All provisions that contradict the provisions of this Decision shall be repealed.

Article 4

All the competent authorities, each one within its sphere of jurisdiction, shall implement the provisions of this Decision, which shall enter into force as of the date of its promulgation and shall be published in the Official Gazette.
