Decree No. 33 of 2007 Concerning the Re-organisation of the Financial Affairs and Salaries of the Personnel of the Palestinian Security Forces
The Chairman of the Executive Committee of the Palestine Liberation Organisation
The President of the Palestinian National Authority
Having reviewed the Amended Basic Law of 2003 and its Amendments,
The Law of Service in the Palestinian Security Forces No. 8 of 2005,
Based upon the recommendation of the Council of Ministers, dated August 6th, 2007,
Based upon the powers bestowed upon me, and
In accomplishment of the public interest,
I hereby promulgate the following Decree:
Article 1
The financial affairs and salaries of the personnel of the Palestinian security forces shall be organised as follows:
1. Preventing restitution, replacement, or entry into records.
2. Limiting security and military courses to the personnel of the Palestinian security forces.
3. Terminating the service of all personnel of the security forces, who are not committed to the legitimacy and are not on duty.
4. Prohibiting all transfers from civil service to service in the Palestinian security forces and vice versa.
5. To be considered a member of the Palestinian security forces shall be a person who has a record at the Administration and Organisation Commission and holds a military rank. It shall be strictly prohibited that a civil servant in any security or military agency be included on the records of the Administration and Organisation Commission with a lump sum salary. It shall be strictly prohibited that any member of the security agencies be included on the records of the Administration and Organisation Commission while he is not present in the areas of the Palestinian National Authority.
6. A committee of the Ministry of Finance, General Personnel Council and Administration and Organisation Commission shall be established to implement the provisions of Paragraph 5 above. This committee shall submit its recommendations to the Council of Ministers within a maximum period of one month from the date [of the promulgation of this Decree] in order to adjust the positions of qualified personnel and personnel on duty and terminate the services of those who do not fulfil these two conditions.
7. The lump sum salary shall continue to be suspended until the committee completes the activities provided for under Paragraph 6 above.
Article 2
All provisions that contradict the provisions of this Decree shall be repealed.
Article 3
All the competent authorities, each one within its sphere of jurisdiction, shall implement the provisions of this Decree, which shall enter into force as of the date of its promulgation and shall be published in the Official Gazette.

بعد الاطلاع على القانون الأساسي المعدل لسنة 2003م وتعديلاته،
وعلى قانون الخدمة في قوى الأمن الفلسطينية رقم (8) لسنة 2005م،
وبناءً على تنسيب مجلس الوزراء بتاريخ 2005/08/06م،
وبناءً على الصلاحيات المخولة لنا،
وتحقيقاً للمصلحة العامة،
مادة (1)
تنظيم مالية ورواتب العاملين في قوى الأمن الفلسطينية على النحو التالي:
مادة (2)
يُلغى كل ما يتعارض مع أحكام هذا المرسوم.
مادة (3)
على الجهات المختصة كافة- كل فيما يخصه- تنفيذ أحكام هذا المرسوم، ويعمل به من تاريخ صدوره، وينشر في الجريدة الرسمية.
صدر في مدينة رام الله بتاريخ : 2007/08/11 ميلادية.
